उत्तरप्रदेश - मुठभेड़ और राष्ट्रीय मानवाधिकार आयोग / विजय शंकर सिंह

अक्सर मैं मुठभेड़ की संस्कृति के खिलाफ रहता हूँ । मैं इसे आपराधिक न्याय व्यवस्था और पुलिस के इक़बाल का क्षरण मानता हूँ।  लेकिन अधिकतर लोग पुलिस द्वारा किये जा रहे मुठभेड़ का औचित्य यह कह कर सिद्ध करते हैं कि सालों साल चलने वाले मुकदमों और इसके बाद भी मुल्ज़िम के बरी हो जाने से अपराधी का मनोबल बढ़ता है। उसे मुठभेड़ में मार देने के अलावा और कोई विपल्प नहीं है। लेकिन मुक़दमे छूटते क्यों है ? सालों साल चलते क्यों है ? इस असल व्याधि पर न तो सरकार, न विधायिका और न ही जनता कोई सवाल उठाती है और न ही कोई निदान चाहती है, बस यह चाहती है कि पुलिस येन केन प्रकारेण अपराधी को पकड़े और ठोंक दे। आपराधिक न्याय व्यवस्था की कमी से कानून को कानूनी ढंग से लागू करने के लिये गठित पुलिस बल, एक्स्ट्रा ज्यूडिशियल किलिंग का आरोपी क्यों बने ? अब आयोग का यह आदेश पढ़ लें, जो 16 मई 2018 की है जब हम सब टीवी पर लोकतंत्र लोकतंत्र खेल रहे थे।

इसकी पृष्ठभूमि इस प्रकार है। सुप्रीम कोर्ट के वकील प्रशांत भूषण और एक मानवाधिकार संस्था, Citizens against hate घृणा के विरुद्ध नागरिक ने 7 मई 2018 को एनएचआरसी के अध्यक्ष पूर्व सीजेआई एचएल दत्तू को एक याचिका दी जिसमे उत्तप्रदेश में हुए 9 ऐसे मामलों की सूची दी जिसमे पकड़ कर जान से मार देने, extra judicial killings के आरोप लगाए जिसे पुलिस ने मुठभेड़ का रूप दिया है। इनमे घरवालों के हलफनामे भी दाखिल किये गये और इसके अतिरिक्त, 8 और मामले भी बताए गए जिनमे घरवालों द्वारा भय से हलफनामा देना नहीं बताया गया। यह भी कहा गया कि यह मुठभेड़ें स्वाभाविक नहीं थी, बल्कि पकड़ कर मार दिए जाने की थीं।  आयोग ने 9 मई 2018 को उत्तरप्रदेश के मुख्य सचिव और डीजीपी को नोटिस जारी कर के इन पर पुलिस का पक्ष रखने को कहा। आयोग पहले भी 22 सितंबर 2017 को यूपी को इन मुठभेड़ों पर स्वतः संज्ञान ले कर यह निर्देश दे चुका है कि वह मुठभेड़ों के बारे में आयोग को जांच कर के बताए। अंत मे जब प्रशांत भूषण और सिटीजन अगेंस्ट हेट ने अपनी याचिका दायर की तो आयोग ने निम्न आदेश दिया।

“ _Considering the gravity of the matter, the Commission requests its DG(I) to constitute an investigating team of five members, consisting of one SSP, two Dy.SPs and two Inspectors to make the fact finding enquiry of all the 17 cases where alleged encounter killings had taken place by recording the statements of affected families and other necessary examination relating to the alleged incident of encounter deaths and to submit report within four weeks. The team to be constituted forthwith. Out of these 17 cases, 15 are already registered with the Commission in which reports have been called for. Rest two cases are hereby registered by issuing notices to the Chief Secretary and the DGP of the State of Uttar Pradesh with a direction to submit detailed reports within six weeks. The Commission also directs DGP of the State of Uttar Pradesh to give necessary directions to the concerned investigating officers in all the 17 cases of alleged encounter killings to submit the status of investigation and produce documents pertaining to cases mentioned above before the Commission and those documents must particularly include (i) FIRs registered in the cases; (ii) relevant chargesheets; (iii) General / Daily Dairy register entry of the relevant Police Station, of the day of incident; (iv) Wireless log book record of the relevant PS (or district police wireless HQ, where such log is maintained) of the day of incident; (v) log book records of the day, of govt. vehicles used by all police officers engaged in the said encounters; (vi) all Details Records (CDR) of mobile phones used by the deceased, any by all police officers engaged in the encounter (date range; one week prior to date of encounter to one week following) within six weeks. Put up after eight weeks._ ”

इन 17 मामलों की जांच में क्या होगा यह बता पाना मुश्किल है। पर अगर कुछ गड़बड़ी मिली तो केवल और केवल वही पुलिस पार्टी फंसेगी जिसने इस मुठभेड़ को अंजाम दिया है। तब पुलिस की पीठ ठोंकने लोग कहीं नजर नहीं आएंगे। अपने सहकर्मियों पुलिस जन को मेरा यह मशविरा है कि कानून को लागू करते समय कानूनी प्रक्रिया का ही पालन करें। मैंने फ़र्ज़ी मुठभेड़ की जांचों में पुलिस के अफसरों को सज़ा भोगते और उजड़ते और जेल में ही मरते हुये भी देखा है ।
